1. Subscription Agreement - By subscribing to Flex Designs' web design services, you acknowledge and agree that you are entering into a binding agreement with us. The subscription period begins on the date of purchase and continues on a monthly or annual basis, depending on your chosen plan, until canceled by you or us.
2. Service Description - Flex Designs provides web design services, including website creation, maintenance, and updates, based on the selected subscription plan. Additional services or features not included in your subscription may be available for an additional fee of $75 an hour.
3. Payment - You may cancel your subscription at any time by contacting our customer support team. However, this will not entitle you to a refund for any unused portion of the subscription period.
4. Cancellation and Refunds - You may cancel your subscription at any time by contacting our customer support team. However, we do not offer refunds for partial subscription periods Flex Designs reserves the right to cancel your subscription at any time without cause. In such cases, we will refund any prepaid fees for the unused portion of the subscription period.
5. Content and Copyright - You are responsible for providing any content, images, and materials required for your website design. You represent that you have the necessary rights to use and publish this content. Flex Designs retains the copyright to the design, layout, and other elements created for your website during the subscription period. Upon cancellation, you may retain the content and data, but you may not use the design for any other purpose.
6. Customer Support - Flex Designs offers customer support during regular business hours. We strive to provide timely and efficient assistance. Support may not cover issues related to third-party plugins, services, or changes made by you or other parties outside of our control.
7. Liability and Indemnification - Flex Designs is not liable for any loss or damage resulting from the use of our services, including data loss, website downtime, or any other issues. You agree to indemnify and hold Flex Designs harmless from any claims, losses, or liabilities arising from your use of our services or any breach of these Terms.
8. Privacy - We collect and use personal information in accordance with our Privacy Policy, which is available on our website.
9. Changes to Terms - Flex Designs reserves the right to modify these Terms at any time. We will notify you of significant changes via email or through a notice on our website.
10. Transfer of Ownership Conditions In order to initiate the transfer of ownership for your site from Flex Designs, it is mandatory for users to maintain an active subscription for a minimum period of (6) six months. Any cancellation of plans before the completion of this stipulated timeframe will result in the non-transferability of the site to the user. Flex Designs reserves the right to retain ownership of the site and all associated content in the event of plan cancellations occurring before the completion of the six-month subscription period.
11 Governing Law - These Terms are governed by the laws of Arizona. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in Arizona. By subscribing to Flex Designs' web design services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree with these Terms, please do not subscribe to our services. These Terms are effective as of the date of your subscription.
